Noise-Induced Hearing Loss [NIHL]
You will no doubt have seen the ongoing publicity in the news, and on social media platforms, regarding claims by military personnel for hearing loss. The MOD has recently accepted that they had a duty of care towards personnel and the agreement reached in the High Court applies to those who served in regular or reserve armed forces since 1987.
Although this is a very positive step in the right direction it has not opened the floodgates or made the process a ‘no contest’ for negligence actions because the MOD may well dispute the extent to which this happened in individual cases. These issues are due to be decided at a trial which is scheduled to take place in late 2025.
If you feel that you have a case for negligence against the MOD, then you should contact a solicitor and seek advice. A civil claim for negligence is a very different process to that of making a claim through the AFCS or the WPS routes. Be aware that civil cases can take much longer to settle compared to going through the AFCS which can often be measured in terms of years not months.
